# Kibitz — Terms of Use

Kibitz is a free, peer-to-peer calling tool operated by the Kibitz project ("we", "us"). By using kibitz.chat you agree to these terms. If you don't agree, please don't use it.

## The service
Kibitz lets browsers place voice and video calls directly to each other. It is free and currently in beta. It is provided "as is" and "as available," without warranties of any kind, and cannot be promised to be uninterrupted, error-free, or available at any particular time.

## No accounts — a link is a key
There are no accounts. A room is just a link, and anyone who has the link can join the call. You are responsible for whom you share your links with.

## Acceptable use
Don't use Kibitz to do anything illegal, to harass or harm others, to infringe anyone's rights, or to transmit unlawful content, and don't attempt to disrupt or attack the service or its infrastructure. You are responsible for your own conduct and for any content you transmit.

## Recording
Kibitz does not record calls, and there is no server in the media path that could. If you choose to record a call using your own device or software, you are solely responsible for doing so lawfully — many places require the consent of some or all participants. Ask before you record.

## AI participants
If you bring an automated participant — an AI agent, bot, or other software that joins a call rather than a person speaking in real time — into a Kibitz room, it must clearly identify itself as automated, using the agent identity and disclosure the service provides, and it must never be presented as a human. An automated participant that listens to, transcribes, or otherwise processes a call is "recording" for the purposes of the Recording section above, so you are responsible for any consent the law requires — many places require the consent of some or all participants. You are responsible for any agent you deploy as if its conduct and content were your own. An automated participant must operate within the role and capabilities it declares — and within whatever a room or its participants grant it. A participant presented as read-only, or limited to particular capabilities, must not perceive, transmit, or act beyond them: for example, it must not emit audio or video, send messages, capture or share a screen, or take in-room actions outside its declared role or granted capabilities. These limits are partly enforced by the software and otherwise rely on this commitment — declaring a restricted role and then exceeding it is itself a violation. To join or remain in some rooms, an automated participant may be required to hold a valid, current access credential; you are responsible for obtaining and keeping it current, and an agent whose credential is missing or has lapsed may be denied entry or removed. Running an undisclosed agent, presenting it as a human, exceeding its declared or granted capabilities, or circumventing a room's credential or other requirements is a breach of these terms, and we may remove the participant and suspend access.

## Disclaimer & limitation of liability
To the fullest extent permitted by law, the Kibitz project is not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of (or inability to use) the service — including any failed connection, dropped call, or unavailability. The service is provided without warranty of any kind, express or implied.

## Changes
These terms or the service may be updated at any time. Continued use after a change means you accept it.

## Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
